General terms and conditions

These terms and conditions govern all online transactions made by a consumer of any kind (hereinafter « the Client ») and the company « Swiss Property Services SA » (hereinafter « SPS SA ») via the online sales platform found on the « moleson.ch/shop » website and its related pages.

Preamble

It is possible to order gift certificates and/or promotional items on the internet. When a purchase is made online, the Client shall log in. Information relating to his/her account shall be saved by the system. By accepting these terms and conditions, the Client also accepts to be contacted by SPS SA or its providers for the promotion of similar or related offers, in accordance with the Swiss Federal law on the protection of data (LPD). SPS SA and its providers shall not share the address of the Client with other third parties.

Online sale of a product or service

The prices shown on the website constitute an offer to purchase. Prices are shown in Swiss francs (CHF) and include all applicable Swiss taxes. Prices in euros are provided for informational purposes only.

Only individuals aged 18 or over may make purchases in our online shop.

Gift certificates

Regarding the online purchase of gift certificates, SPS SA shall transfer a tamper-proof code to the Client. This code may be a number, a QR code or a barcode. As the Client shall print the gift certificate himself/herself, it is possible to make multiple printouts. However, the gift certificate may only be used once. After its first usage, all subsequent attempts will be considered as attempted fraud. Where necessary, SPS SA reserves the right to initiate appropriate penal measures.

As gift certificates are not personalised, they are taken to belong to the holder. SPS SA and its sub-contractors have no obligation and are not able to verify the identity of the user. The buyer or the final recipient of the certificate cannot claim ownership of a gift certificate if the gift certificate has already been used. Only the tamper-proof code is checked upon use.

Delivery of gift certificates

Gift certificates and confirmation of purchase are sent free of charge by email by SPS SA. Gift certificates shall be printed by the Client and presented to the service provider upon arrival.

In all cases, the Client is considered responsible for protecting his/her gift certificates from theft or non-authorised reproduction.

Damaged items

Merchandise and gift certificates shall be verified upon reception. Should an item be faulty, the Client shall inform SPS SA by email within 48 hours of reception in order to claim any possible compensation. SPS SA shall then inform the Client of the procedure to follow.

Damaged or faulty items shall be returned with a note specifying the name, order number and the reason for return, as well as the Client’s preferred means of compensation, within 48 hours of reception. Depending on the defects and availability, a replacement will be provided, or the item will be refunded.

Any refunds shall be issued directly to the card used for the initial transaction, once the item has been returned.

A refund is not provided in the case of claims relating to errors in illustration, text or prices, or to delivery delays. Items are subject to price changes and minor modifications; this does not give a right to refund.

Cancellation – Insurance

Orders placed online are final and gift certificates shall not be refunded, even in the case of non-use of the certificate, illness or accident, the closure of facilities, or poor weather conditions. Gift certificates purchased online may be neither refunded nor exchanged for another service. Lost gift certificates are not replaced and cannot be refunded in cash. Expired gift certificates which have not been used cannot be extended, exchanged, replaced or refunded.

Payment

Secure payment is made using the SAFERPAY credit card system.

The card number is sent to the bank’s servers and the transaction takes place in a secure environment. Security is further guaranteed by the fact that the card number is only seen by SAFERPAY.

The confirmed order shall only be considered effective when the banking payment centres involved give their authorisation. If the banking payment centre refuses the transaction, the order shall be automatically cancelled and the Client shall be advised by email. Furthermore, SPS SA reserves the right to refuse any order placed by a Client with whom there is a dispute.

Order confirmation

Once the payment has been made and accepted by SAFERPAY, a confirmation email providing an overview of the order is sent to the Client by email.

Acceptance of conditions

The Client confirms that he/she has acknowledged the above points at the time of placing his/her order and has accepted them without reserve.

These terms and conditions govern the contractual relationship between SPS SA and the Client.

These terms and conditions take precedence over all other conditions featured in other documents, except in the case of prior and written express exemption.

Disputes

The present contract is subject to Swiss law.

SPS SA cannot be held responsible for material, immaterial or bodily damages which could result from the malfunction or misuse of gift certificates or traded goods. The same applies to all erroneous orders, incorrectly entered information at the time of registration, erroneous date of birth, etc.

SPS SA can in no way be held responsible for simple errors or omissions which may occur in spite of the care taken in the presentation of gift certificates.

It is reminded that as a general rule and subject to the evaluation of the courts of law, respect of the provisions relating to the contractual guarantee requires that the Client has met his/her financial commitments to the vendor.

Any claims or complaints shall be studied with care, and good faith shall be presumed on the part of the person who takes the trouble to explain his/her situation. In case of dispute, the Client shall first contact SPS SA to try to obtain an amicable solution.

Failing this, the district court of La Gruyère (Tribunal d’arrondissement de la Gruyère) has sole jurisdiction, regardless of the place of delivery and the form of payment accepted.

Guarantee

SPS SA cannot be held responsible for the non-respect of regulatory or legislative provisions in force in the country of the Client.

Liability of SPS SA is systematically limited to the value of the gift certificate or the item concerned, value at the date of sale and without recourse to the brand or company producing the gift certificate.
